A MERSEYSIDE thalidomide victim has gone on hunger strike in protest at the Government’s refusal to pay compensation to those affected by the drug.

Ivo:
Any law book on product liability will tell you that thalidomide shows that and why we need product-liability laws.

Guv’mints are liable for thalidomide because their regulators allowed thalidomide on the market and when the whistle on thalidomide was blown at a Düsseldorf congress of neurologists on 30 April – 01 May 1960, those same regulators have not done anything.
Thalidomide was eventually taken from the market on 27 November 1961, by its maker, Chemie Grünenthal GmbH, and thus not by the regulators who had allowed it in the first place. Comprendo?

Gary says that he has not a normal life expectancy and that if this process has to be accelerated because of our cause, then so be it.

Yes, our Masters continue to argue that thalidomide shows the need for a welfare state, c.q. a police state,
while at the same time continuing to refuse compensation for the damage thalidomide monsters like myself suffer as a result of the guv’mints’ intentional acts of letting thalidomide be marketed for more than 18 months after 01 May 1960.

It is about time that this comedy stops.

The Sunday Times reported on 13 September 2009 that documents have emerged which suggest that scientists led by a British professor had discovered a compound with an almost identical chemical formula to thalidomide in 1949.

    What does guv’mint want?

Guv’mint needs thalidomide to justify or legitimate its welfare state, including its NHS.
But at the same time, guv’mint refuses to compensate thalidomide monsters for this need.

Guv’mint wants to have its cake and eat it too.

    Ivo:
Mr Andrew Lansley, shadow health secretary, please listen.

The question is not whether the future Tory guv’mint will have extracted enough money from the taxpayer to compensate our damage.

    The questions are
    (1) what damage do we suffer?
    (2) who is responsible for this damage?

    You are responsible for it.

If you cannot pay your debt, then your guv’mint should go out of business and leave this country.

Yes, I know, the money we would get comes from taxation and the difference between tax and theft is that the thief does not come back periodicalky, nor does the thief pretend to stealing in the public interest.

Well, if your guv’mint agrees with this argument, it should also go out of business and leave this country.

  4. Ivo Cerckel Says:

You see, the welfare state supersedes the rules of civil (and criminal) liability of guv’mint.

That’s why Mr Andrew Lansley, shadow health secretary, can say:
“I can’t possibly do that. I have every sympathy for their situation but we are talking about giving taxpayers’ money to people in circumstances where, if I were to make promises in opposition, I may find there are legal constraints.”

  5. Ivo Cerckel Says:

And when will we be compensated for the difference in value between the life we would have had and the life of circus animal we have now?

Over the Atlantic, producers fear exorbitant jury verdicts in product-liability cases.
Could we not get a shyster lawyer from over there, to get an “exorbitant” judgment here for thalidomide monsters?

  6. Ivo Cerckel Says:

Of course, if thalidomide was developed in the US of A (1), we could get a jury verdict there.

But that may not even be necessary.

In the old days, we were taught [Hi Peter, now in Essex apparently] that jurisdiction of US courts was dependent upon “minimum comtacts”. (2)

Thalidomide was definitely known in the year 1938 and [its] defects were noted in Phoenix, AZ (USA) in a medical journal that year. It was known as a cure for [Hansen]’s Disease and made by [Richardson]-Merrill Co. in [Cincinnati], OH (USA). 9. Ivo Cerckel Says:

Even in my native Belgium, which I left nine years ago due to lack of funds for the third world, things seem to be changing.

The country has still not recovered from the 1962 trial whereby the mother murderer of a thalidomide monster born in May 1962, that’s two years after the Düsseldorf warning, was acquitted. (1)

The Belgian guv’mint never set up something like the Thalidomide Trust, although it had committed itself to seeting up such a thing.

The nice thing about Belgium is that J. Custers, minister of health, said in 1962 that the guv’mint should have grasped [the Düsseldorf May 1960 warning] and that therefore the people of Belgium, not the guv’mint of Belgium, should leave Belgium (“n’a plus qu’à s’en aller”). (2)

Maybe now, I will get my first franc, euhr euro, of compensation. (3)

  10. Ivo Cerckel Says:

Like Catilina, I am conspiring against guv’mint.

Unlike Catilina, I am conspiring alone.

I am conspiring alone against guv’mints
because they let thalidomide on the market for more than 18 months after 1 May 1960
and because they let my medical-doctor father Henri Cerckel,
or Hendrik Cerckel since 18 months, when I (born 02.1962) learnt of the Düsseldorf congress and explained this on the internet,
getting away with administering thalidomide to my mother
(I was the first-born child – two of the three other children of parents have since then committed suicide (1986 and 2007), my mother also committed suicide (1977).

And then the Belgian guv’mint acquitted the murderers of a girl born three months after me.

Our Masters needed thalidomide to justify or legitimate their welfare state.

And then UK shadow health secretary Lansley is arguing that the rules of the same welfare state prevent compensation of the damage suffered by thalidomide monsters.

Is this a joke? Or just a bad dream? Or what?

  11. Ivo Cerckel Says:

    Of course.
it’s because they needed thalidomide for their welfare state,
that’s why our Masters let it on the market for 18 months after 1 May 1960.

  12. Ivo Cerckel Says:

And then they argue that we need product-liability laws, just like in Pittsburg, the G20 is now conspiring to destroy everything.

The crisis is due to unbacked at least irredeemable paper money and fractional-reserve banking. (1)

But German chancellor Angela Merkel, who’s coming up for re-election or not this week-end in Germany, is arguing that market regulation is more important than the rebalancing of the economy. (2)

That’s what our Masters, who let thalidomide on the market for 18 months after the Düsseldorf 30 April -01 May 1960 warning, also said after thalidomide: ‘we, bureaucrats, need more regulation”.

At the end of the day, Merkel will have nothing to regulate.
